Introduction

The terms and conditions stated below, govern the use of our services and our application and also the content on this website. Please read them thoroughly, as the use of our products and services implies that you accept these terms and conditions and are subject to them.

AppsKnack.com, for the purposes of this document, will be referred to as AppsKnack.com

Relationship

The relation of AppsKnack.com with the Client will be that of a contractor and nothing will create an employer-employee relationship, partnership or joint venture. In accordance with this fact, AppsKnack.com is not entitled to any benefits that a client may ordinarily extend to its employees, and does not have authorization to make any commitment, contract or representation on the Client’s behalf unless specifically authorized by the Client. Both parties hereto understand that neither of them has the authority to bind the other in any contractual arrangement with any third party.

Services

During the engagement, AppsKnack.com will create an application with your logo/branding. This is a hosted solution and a content management system will be provided to you that will help you manage the content of your application.

Intellectual Property Rights

By choosing our product and services the client agrees that AppsKnack.com will not provide the source code of the application, as it’s a hosted solution. The copyright of the source codes, images, icon, etc used for app design, development and management will be the intellectual property of AppsKnack.com. Also, the client’s engagement with AppsKnack.com unconditionally guarantees that any elements of copy, images, related graphics, design, trademarks, third party logos or other artwork provided to AppsKnack.com for inclusion in the website through the CMS are owned by the Client or that the client has permission from the rightful owner to use each of these elements. The client will hold harmless, protect and defend the Company and its subcontractors from any claim or suit arising from use of such elements furnished by the Client.

Approvals and modifications

AppsKnack.com has in place a structured and systematic approach towards the design and development of an application. Upon confirmation of the payment by the client, the AppsKnack.com app development team will set up the content management system on its server followed by the creation of a splash design page incorporating the client logo. This is sent for approval to the client. After receiving client approval, AppsKnack.com will start the app development process and integrate your splash page within the app and send it to client for further approval. Once the client approves the app, AppsKnack.com will go ahead and submit it to the app store. The customization of the application by AppsKnack.com only includes theme modification and addition of your logo/brand identity. Everything else remains the same. Further customization will be charged additionally.

Payments and Refund Terms

The payment will be made on the basis of the plan that you select. The available plans are as follows:

Once you select a plan, you need to make the payment. AppsKnack.com will begin work on your application only after receiving payment confirmation. AppsKnack.com will do its best to make sure that the apps store will approve your apps. If your app is rejected, you will be refunded in full. However after the order confirmation, if client wants to cancel the subscription, no refund will be processed.

Cancellation and Termination

• The onus of the proper cancellation of the subscription rests with the client. Subscription cancellation requests must be submitted to. Cancellations by phone or sent to other email addresses will be considered invalid.
• AppsKnack.com has the right to suspend or terminate the client subscription and refuse access to the hosted application, for any reason, at any time, without any refund of monies paid. Such termination of service will lead to cancellation of your subscription, restricting further access to your content management system and also the forfeiture and relinquishment of all content in your Account.
• AppsKnack.com can refuse service to anyone for any or no reason at any given time. Such refusal may be a result of, but not limited to, the client using content that AppsKnack.com determines to be violent, obscene or offensive; or advocates violent or illegal activity, or contains computer viruses, contravenes any law, statute, or ordinance or is seen to violate these Terms and Conditions.

You expressly understand and agree that AppsKnack.com shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of, or your inability to use , the application

Governing Law

These Terms and Conditions shall be governed in accordance with the laws of the Government of Gujarat, India.

Amendments

AppsKnack.com reserves the right to change/amend these terms and conditions at any time. Clients of AppsKnack.com have to check the ‘privacy statement’ as well as, the ‘terms and conditions’ pages on the website periodically, to remain aware of any changes that may be made from time to time. The use of this website or AppsKnack.com products and services constitutes your acceptance of those changes.
